Motor Vehicle Accidents

New legislation governing car accidents compensation has been passed in Ontario. When you are in a car accident, you are entitled to ACCIDENT BENEFITS, but you may also have THE RIGHT TO SUE FOR DAMAGES if you have a “serious and permanent injury”. You should contact a lawyer immediately upon being in a car accident, as benefits may be available to you immediately, and strict deadlines exist for making a claim for damages.

Slip and Falls

All property owners and businesses have a duty to provide a safe environment for people on their property. If they fail to do so and someone is injured as a result, they may be held responsible for the injured person's pain and suffering, lost wages, and medical treatment. An “Occupier’s Liability” case might arise against owners not only of commercial property, but private residences, vacant lots and many other types of properties.

Probably the most common type of premises liability situation is where someone slips or trips and falls due to some defect or hazard on another person's property. A classic example of this is where a shopper in a grocery store falls due to a slippery or wet substance on the floor. If the grocery store knew or should have known about the substance, and failed to clean it up or warn shoppers about the substance, then it might be liable for its negligence. Other instances where premises liability might arise include: broken or cracked sidewalks; trip and falls on stairs or escalators; and slip and falls on ice or snow that has not been properly removed or treated.

Disability Insurance Disputes

Many employees are enrolled in group insurance policies that provide for monthly payments in the event that en employee becomes disabled. The employee will usually be entitled to benefits for both Short Term Disability and Long Term Disability. Insurance companies are notorious for being very difficult when it comes to evaluating a disability claim and will often prematurely terminate benefits without justification. Dog Bites

Dog owners are responsible for ensuring that their pets do not cause harm to others. When a dog attacks a person, the resultant injuries can sometimes be severe, requiring emergency and ongoing medical treatment. Scars and disfigurement can occur in serious cases, and in the worst scenarios, victims may be killed. Children are often bitten by dogs after unknowingly provoking them. In most cases, the dog owner's homeowner's insurance handles injury claims. If an attack happens while the victim is legally on private property (e.g. an invited guest, to deliver mail, etc.) or while the victim is on public property, the owner is typically liable as long as the victim was not intentionally and persistently antagonizing the animal.
